Mediation is a structured but informal dispute resolution process in which the third party neutral, the mediator, facilitates a discussion between the parties in an effort to assist the parties in reaching a mutually acceptable resolution. The mediator does not issue an award or decision, but if the parties are able to reach an agreement, the mediator assists them in writing a clear, unambiguous document detailing their resolution. Mediation is confidential and neither the mediator nor the parties are to testify about what they hear or observe in the mediation session. Exceptions to this rule are matters involving fraud, waste, or criminal activity.
Mediation Mentoring is a coaching type procedure in which the mediator mentor observes the new mediator mentee as he or she actually conducts a real mediation. The mentor acts as a resource for the mediator during the mediation. After the mediation, the mentor orally debriefs the mentee on the things he/she did well and things that need improving as a mediator. A written and signed report is the submitted to the mentee his/her supervisor detailing the points made in the oral briefing.
Facilitator is an impartial process guide who is responsible for managing the discussion so that parties can focus their attention on substantive issues and achieve their goals. This person is impartial toward the issues or topics under discussion. The facilitator also provides procedural directions as to how the group can move efficiently through the problem solving steps of the meeting and arrive at the jointly agreed upon goal.
Early Neutral Inquiry Facilitator is a third-party neutral who listens to the facts and arguments of the case and then provides the parties with a legal opinion, which is not legally binding, about the range of outcomes that they might expect if they litigated the case in court.
Arbitrator hears a parties' dispute and makes a decision for them. An arbitrator is informal and the rules of evidence are not strictly applied. The arbitrator may or may not provide reasons for the award, and the disputing parties may select the person who will serve as arbitrator.
Ombuds investigates complaints and mediates fair settlements between aggrieved parties such as consumers or students and an institution or organization.
Neutral Settlement Conference Facilitator listens to you and the other parties and reads your short written statements. The facilitator gives an opinion on the strong and weak points of each party's case.
Conciliator builds a positive relationship between the parties to a dispute. The conciliator assist parties by helping to establish communication, clarifying misperceptions, dealing with strong emotions, and building the trust necessary for cooperative problem-solving. Conciliators may provide for a neutral meeting place, carry initial messages between/among the parties, provide reality testing regarding perceptions or misperceptions, and affirm the parties' abilities to work together.
Partnering is a formal process that brings key project participants (stakeholders) together to communicate effectively and work as a team to define and achieve mutually beneficial goals. An effective partnering effort relies on each stakeholder understanding the communication styles, goals and organizational interests of the other members. Partnering is a "process" because it requires action, not just words.
